Terms and Conditions

Terms governing use of the EPRlog software and services.

1. Agreement

By accessing or using EPRlog you agree to these Terms. If you do not agree, you may not use the service. "Software" means the hosted EPRlog products; "Customer" is the entity that purchased access; "User" is an individual the Customer authorises; "Customer Data" is information the Customer or its Users submit.

2. The software

EPRlog is a hosted compliance backbone for Extended Producer Responsibility: it captures collection evidence, maintains a tamper-evident audit trail, and produces regulator-format reports. We may upgrade, maintain and alter the Software at our discretion, provided we do not intentionally cause loss of Customer Data or materially reduce the Software's core utility during a paid term.

3. Fees

  • The field-capture application is provided free of charge to collectors and contractors.
  • Producer and PRO plans are agreed on an order form; fees are payable in advance.
  • All payments are processed via Stripe. Operator payouts, where enabled, are routed through our licensed payment partner; EPRlog does not take custody of those funds.

4. Licence and acceptable use

Subject to these Terms, the Customer receives a limited, non-exclusive, revocable licence to use the Software. You agree not to: share credentials between individuals; use the Software for unlawful or abusive purposes; copy, reverse engineer or decompile the Software; or exceed licensed usage. We may suspend access for an unremedied material breach.

5. Customer Data

  • You retain all rights to your data; we obtain no title to Customer Data.
  • You are responsible for the accuracy, quality and legality of the data you submit and file.
  • We may retain compliance records as required by applicable regulation and may suspend the service for outstanding payment.

6. Data protection

We comply with applicable data-protection law including GDPR and POPIA. When acting as a Data Processor we process data only on your written instructions, apply appropriate security measures, notify you of qualifying breaches without undue delay, and delete or return data on termination. The Data Processing Addendum forms part of this Agreement.

7. Intellectual property

The Software and all associated intellectual property remain the property of EPRlog. You own the reports and records generated from your data (excluding the underlying templates and layout). You may not use the EPRlog name or marks without consent.

8. Warranties and service levels

  • We warrant the Software will materially perform the described functions.
  • We target 99.9% monthly uptime, excluding scheduled maintenance and events outside our reasonable control.
  • Except as stated, the Software is provided "as is"; we do not warrant uninterrupted or error-free operation.

9. Liability

  • You use the Software at your own risk. Our total aggregate liability is limited to the fees paid in the twelve months preceding the claim.
  • We are not liable for indirect, consequential or incidental damages, nor for third-party infrastructure or regulator-portal availability.

10. Term and termination

  • Either party may terminate for a material breach not remedied within 28 days, or immediately on the other's insolvency.
  • On termination you may export your data for 30 days, after which we may delete it subject to legal retention.
  • Pro-rata refunds apply only where we terminate without cause.

11. Confidentiality and force majeure

Each party keeps the other's Confidential Information secret. Neither party is liable for failure to perform due to events beyond reasonable control, including acts of God, war, epidemic, or government action.

12. General

You may not assign this Agreement without consent. We may reference the Customer's use in promotional materials only with prior written approval. No waiver is effective unless in writing. We may amend these Terms on reasonable notice. This Agreement is governed by the law stated on the order form and the parties submit to that jurisdiction's exclusive courts.
